What is Induced Employment?

This is a form of employment practice by which an employer, through inducement, deceit or influence persuades a job seeker to proceed beyond the boundaries of Zambia for work

What does the law say?

The law states that the use of inducement, deceit or influence to source employees to work in another country is an offence in terms of Zambian labour law. It says it is illegal and unlawful for any potential employer to induce any person to proceed abroad without a Contract of Foreign Service.

Can an employer be punished for inducing employment?

Yes, any person who induces or attempts to induce any other person to proceed beyond Zambia for the purpose of employment outside Zambia otherwise than in accordance with the provisions of the Employment Act, or any person who knowingly aids in the employment or transfer of any person so induced, shall be guilty of an offence and liable to a fine not exceeding four thousand penalty units or to imprisonment for a term not exceeding one year, or to both.

What to do if you are a victim of induced employment

Report the matter to the nearest Zambian high commission, embassy, consulate or police station. If you are not in possession of your personal identity documents like National Registration Card, passport, work permit, travel document or Contract of Foreign Service, report yourself to local authorities within the country of your presence or the nearest International Organisation for Migration (IOM).
